This is an appeal preferred by the insurance company against the order of the Dist. Forum in

 

The case of the complainant in short          

 

He spent Rs. 1,02,828/- .     

 

The appellant insurance company resisted the case.                

 

The complainant in proof of his case filed his affidavit evidence    

 

The Dist. Forum after considering the evidence placed on record opined that there is no evidence to show that the patient had history of chest pain., and that she suppressed it   deficiency in service, and therefore it directed the appellant to pay Rs. 1 lakh with interest @ 9% p.a., together with costs of Rs. 500/-.

 

 

 

Aggrieved by the said   

 

It is undisputed fact that the complainant               When he made the claim on                     

 

 The insurance company did not adduce any evidence to show that the insured was aware                deficiency in service.   

 

It is unfortunate that these insurance companies repudiating the just claims though the National Commission also long back      

 

 

 

 

 

 

 

 

We have closely perused the entire material   

 

In the result the appeal is dismissed with costs computed at Rs. 2,000/-.
