Order dated 26.04.2012 passed by the Goa State Consumer Disputes Redressal Commission, Panaji (in short, he State Commission in First Appeal no. 19 of 2010, the petitioner has filed the present revision petition seeking setting aside the dismissal of the appeal and for its restoration. By the impugned order, the State Commission has dismissed the appeal filed by the appellant due to the absence of the appellant or its counsel. The counsel for the petitioner states that non-appearance of the appellant or its counsel was due to the incorrect noting down the date of hearing and there was no deliberate intention to absent from the proceedings. For these reasons, the appeal needs to be considered on merits. We, therefore, set aside the impugned order and restore the appeal on the board of the State Commission, subject to deposit of cost of Rs.5,000/- with the Consumer Legal Aid Account of this Commission within four weeks. Parties are directed to appear before the State Commission on 7th November 2012.
