        Both counsel present. 

        A memo is filed by the learned counsel for the appellant  stating that an amount of Rs.14,984/- by way of D.D. bearing No.00920 drawn on ICICI bank dated 21-6-2010  was taken in favour of the respondent towards full and final settlement of the case and the learned counsel for the respondent acknowledged the settlement and receipt of D.D..

        In view of the memo, this appeal is dismissed as settled out of court.  There shall be no order as to costs.

        The counsel for the appellant is permitted to withdraw the statutory amount by filing an appropriate petition.
