       This case record is taken up for consideration in the matter of passing order in respect of application filed by the applicant (OP No. 3) of CC Case No. 268/2021 for appointment of Hand Writing Expert .  This matter has been contested  by OP who is the complainant of the above noted complaint case.

            Heard Ld. Advocates of both sides.  Considered submission.

Perused the application which is filed by the applicant for appointment of  the Hand Writing Expert.

On close examination of the said petition it appears that the applicant side has not described any schedule in respect of which the Hand Writing Expert  is to be appointed.  Moreover, the applicant side has also not filed any admitted signature and hand writing of the OP (who is the complainant of the above noted complaint case). In the absence of  any schedule of  subject of Hand Writing Expert examination and in the absence of admitted signature and hand writing  of the parties, there is no scope of allowing the above noted prayer of the applicant.

So, prayer for appointment of the Hand Writing Expert  is rejected on contest.  No order is passed as to cost.

In the light of the observation made above this MA Case being No. 96/2023 is disposed of.
