  1.    This is an appeal filed U/s.73 of CPA 2019 by OP.1/Appellant aggrieved by the order dtd.14.12.2023 passed in EA/154/2022 pending on the file 1st Addl., District Commission, Bengaluru urban which is arising out of the order dtd.20.06.2022 passed in CC/468/2021.

 

  1. We heard the learned counsel for Appellant/Jdr. Perused the impugned order and award passed in CC/468/2021. Accordingly found satisfied to dispense with issuance of appeal notice.

 

  1. This appeal is filed to set aside the order dtd.14.12.2023 passed in EA/154/2022. Learned counsel submits that Jdr/Appellant is making genuine efforts to see that award to be satisfied in favour of Complainant/Dhr. He has explained reasons for not satisfying the award amount in EA filed U/s.73 of CPA 2019 and sought to pay in instalment of Rs.25,000/- each. We perused the proceedings sheet in EA/154/2022, wherein could see recording of part payment on the dates fixed for execution. The Executing Commission ordered to issue arrest warrant against Jdr/Appellant herein. In view of his undertaking to pay the remaining outstanding dues towards award under complaint, it would be just and proper to dispose of this EA with a direction to District Commission to consider his request and to allow him to pay the remaining amount within a time to be fixed and allow him to pay a sum of Rs.2 lakhs each in a month. With this observation, appeal stands disposed of with a direction to the Jdr/Appellant herein to participate in the EA proceedings and to convince the Executing Commission to grant time to its satisfaction and satisfaction to the Dhr. Arrest warrant issued against Jdr/Appellant by the District Commission is with held till next date fixed in EA/154/2022 and proceed with the matter in accordance with law.

 

  1. Notify copy of this Order to the District Commission and parties.
