Today is fixed for admission hearing.

Ld. Advocate for the complainant is present. Perused the complaint petition and annexure thereto.  Heard Ld. Advocate for the complainant on admissibility of the Consumer Complaint. Considered.

It appears that the complainant filed an accident claim for Rs.15,00,000/- with the OP-1 Tata AIG Insurance Co. Ltd. in the year 2020 as being the legal heir of deceased Pankaj Mondal the insured.  The Policy No. of the same is 0158981856 having Claim No. 7210065566 and after receiving the claim number from the OP-1, the complainant tried to contact the OP-1 for her claim but the OP-1 did not pay any attention to the complainant in spite of E-mail dated 10.07.2020.  Even demand notice was sent to the OP-2 on 27.02.2021 but all are in vain. 

On careful scrutiny nowhere in the complaint petition it whisper that the OPs have repudiated the claim of the complainant.

In view of the above, we are of the opinion that the instant Consumer Complaint is a premature one and as such same is not admitted for further proceeding.  However, the complainant is at liberty to file afresh having repudiation letter if any on the same cause of action, if so advised and if not otherwise barred by law.

The CDF Unit-II CC No. 278/2023 is thus disposed of.
