Complainant files hazira through Advocate.

No step is taken by the O.P. who is found absent on repeated call.

Notice was duly served upon the O.P. through e-mail.

No W.V. has been filed within the statutory period.

The case is taken up for Ex-Parte hearing.

The Complainant’s case is that he made an advance of Rs.60,000/- under receipt dated: 22/03/2023 to the O.P. for purchase of a Rice Harvester Machine No. being DC-68-GHK2 in exchange of the old Harvesting Machine but the Complainant neither received the delivery of the product nor the return of the advance money despite reminder through Advocate’s letter dated: 12/06/2023 and thereafter self-written communication dated: 26/07/2023.

Perused the petition of complaint and the documents on record.

Heard Ld. Advocate for the Complainant.

Prima-facie case of the Complainant is well established.

The Complainant is entitled to get the relief as prayed for.

Hence it is ordered…….

That the case be and the same is allowed Ex-Parte against the O.P. but without cost.

O.P. is directed to pay to the Complainant Rs.60,000/- with Litigation Cost of Rs.10,000/- within a month from this date in default law will take its own course.

Both parties be supplied copy of this Order free of cost.
