ORDER

This revision petition has been filed by the revisionist for setting aside order dated 06.12.2019 passed by District Consumer Disputes Redressal Forum-I, U.T., Chandigarh (in short ‘the Forum’) in complaint case No.957 of 2019 vide which, the opposite party (revisionist herein) was proceeded against exparte for not putting in appearance.

                   Counsel for the revisionist has submitted that the revisionist could not appear on the said date i.e. 06.12.2019 as the case was not shown in the cause list appearing on the Commission’s website.

                   We had called for the report of Reader of the Forum concerned, which has been received. The said report transpires that the case was added by hand in the cause list by creating new entry at Sr. No.7-A.

                   Moreover, from the computer of this Commission, the cause list dated 06.12.2019 has been downloaded wherein the said case is not depicting even today.

                   We are of the opinion that on account of not showing the case in the cause list dated 06.12.2019 uploaded on the office website, a grave prejudice has been caused to the revisionist.

                   Counsel for the revisionist has submitted that he has already filed reply before the Forum.

                   Accordingly, this revision petition is allowed. The impugned order dated 06.12.2019 passed by District Forum-I, U.T., Chandigarh, proceeding the opposite party exparte, is set aside. Consumer complaint No.957 of 2019 is remanded back to District Forum-I, U.T., Chandigarh with a direction to proceed further in accordance with law and after giving both the parties opportunity to file reply, evidence, rejoinder etc. Further direction is issued to the said Forum to get the cause list dated 06.12.2019 corrected on the office website.

                   The parties/their Counsel are directed to appear before District Forum-I, U.T., Chandigarh on 09.03.2020.

                   Complete record of complaint file be sent back to the Forum concerned alongwith certified copy of this order, so as to reach there before the said date.

                   Certified copies of this order be sent to the parties, free of charge.

                   File be consigned to the Record Room after completion.
