Per – Hon’ble Mr. Shashikant A. Kulkarni, Presiding Judicial Member

          We have heard learned Adv. Vinayak G. Kulkarni on behalf of the Applicant/Appellant and learned Adv. Sunil V. Naik instructed by Adv. Dr. Shreeram Arvind Karandikar on behalf of the Non-Applicant/Respondent No.1 on the application for condonation of delay.  We did not have the benefit of hearing anyone on behalf of the Non-Applicant/Respondent No.2.  We have also carefully perused the material placed on record and more particularly, application for condonation of delay.

          Applicant/Appellant is a government organization requiring to take prior sanctions and permissions before filing of an appeal.  Delay in filing appeal is marginal and does not appear to be intentional.  Hence, Miscellaneous Application No.189 of 2015 seeking condonation of delay in filing First Appeal No.409 of 2015 is hereby allowed.  Consequently, delay in filing appeal stands condoned.  Applicant/Appellant shall pay costs quantified at Rs.500/- to the Non-Applicant/Respondent No.1.

          Now, list this appeal for hearing on admission on 11/08/2015.
