Brief facts of the case:-

Case in hand is the allegation of  deficiency in service and unfair trade practice by the O.Ps  for  not  to seize   two wheeler finance vehicle bearing  Regd. No. OD-18-G-2465 which  the complainant sought  redressal.     

The O.Ps not appeared though notice has been  duly served resultant made exparte.

Heard from the  complainant.  Perused the record, documents filed by the  complainant.

Undisputedly the  complainant  had availed   loan  for  purchase of  the vehicle two wheeler  Bajaj Platina  bike bearing Regd. No.OD—18-G-2465  for   a sum of Rs.42,000/-  vide  hypothecation  loan  agreement  No.  L2WRGD 07749186  on Dt. 12.10.2019. The complainant was to pay  the total amount  of  Rs.57,028/- which was also included interest a sum of  Rs.15,028/- in 27   E.M.I.  monthly  installments @ Rs.2,114/- for the period from 12.10.2019  to  6.3.2021   (copies of the  loan documents and E.M.I list is available   in the file which is marked as  Annexure-I).

            The main grievance of the complainant is that without proper notice  the  O.Ps had threatened  to seize the vehicle  by  using local Gundas in forcefully  and  demanded   excess amount   which is arbitrary, whimsical.  Hence the present  C.C. case filed by the complainant.

We deem it just and proper that out of the total E.M.I. a sum of Rs. 57,028/-  the complainant  has already been   paid a consolidated E.M.I. 90%.  Remaining  E.M.I. amount of  10%  is to  be deposited in  the counter  of the  O.Ps  by the complainant.

Thus, in context of maintaining good relationship,  between bonafied  customer, this commission  feel  it is just and proper that the O.P.  should have received  the balance  E.M.I. from the complainant  towards  loan  agreement  No.  L2WRGD 07749186.

            In resultant the complaint stands allowed in part against  O.Ps  on Exparte.

                                                ORDER.

The  complainant is directed to deposit only outstanding E.M.I. in the counter of the O.P. after obtaining  statement from the O.Ps counter. The O.Ps are directed to receive the  only  outstanding E.M.I. from the complainant  and not to charge over due penal interest or any charges.  Further the  O.Ps are directed to issue N.O.C. after receiving the outstanding E.M.Is from the  complainant towards  loan  agreement  No.  L2WRGD 07749186 two wheeler  Bajaj Platina  bike bearing Regd. No.OD—18-G-2465   in favour of the complainant. 

The O.Ps are directed shall  not charge overdue penal interest beyond the guide lines fixed by the R.B.I. and   not to seize / repossess without  observing  due process of  law.  

The entire directions shall be carried out with in 45  from the  date of receipt   of this order.

Miscellaneous  order if any  delivered by this  commission  relating to this case  stands vacated. 

 A copy of this order be provided to all the parties at  free of cost as mandated by the Consumer Protection Act,  2019 or they may download same from the confonet.nic.in to treat the same as if copy of order received from this Commission.
