No doubt the Complainant in support of his case has placed on record the C.D.  purportedly recording the videography of the discussions that took place between  the Complainant and the Opposite Party no.2.  However, as the opposite parties have questioned the genuineness of the C.D and have alleged that it is doctored and manipulated to suit the Complainant, the Complainant therefore should have taken more precaution in proving the said C.D. under the Evidence Act.   Moreover the complaint is also defective for non-joinder of manufacturer of the forteo injection i.e. Eli  Lily & Co. (India) Pvt. Ltd.,

We therefore are of the opinion that as  the Complainant has failed to prove his case,  the complaint requires to be dismissed.  Complaint dismissed without costs.
