Complainant files hazira through Advocate.
No step is taken by the O.P. who is found absent on repeated call despite service of Notice additionally sent through email nor any written version is filed within the statutory period.
The case is taken up for Ex-Parte hearing.
The Complainant’s case is that she invested Rs.1 Lakh with O.P./Investment Co. by transferring the amount through her Joint Bank Account No. being 426010100009760 to the Account of the O.P. on 08/10/2021 on condition to get Rs.2,000/- per month for five years but till now she has received Rs.16,000/- from 08/11/2021 to 11/07/2023 together with Rs.1,000/- on 10/10/2023. The Complainant made demand of regular payment of Rs.2,000/- from month to month as per terms and condition of the investment through email correspondence dated:06/10/2023 and lastly on 09/01/2024 but no response is received from the O.P. The Commission has gone through the petition of complaint and the documents on record. On perusal of all the materials on record and hearing the Ld. Advocate for the Complainant the Commission finds that the Complainant is to get return of Rs.2,000/- per month from the date of her investment of Rs.1 Lakh with O.P./Investment Co. but till now she has received monthly return of Rs.2,000/- per month for eight months only with Rs.1,000/- but she is unsuccessful in getting periodical return out of the aforesaid investment. The Complainant could not however show any document of receipt of Rs.16,000/- plus Rs.1,000/- but the Commission in absence of any rebuttable evidence by the O.P. has to accept the statement of the Complainant in this regard.
Prima facie case of the Complainant is established.
The Complainant is entitled to get the relief as prayed for.
Hence it is ordered…….
That the case be and the same is allowed Ex-Parte against the O.P. but without cost.
O.P.s are directed to pay to the Complainant Rs.1 Lakh being the principle investment amount minus Rs.17,000/- already paid within a month from this date in default law will take its own course.
Both parties be supplied copy of this Order free of cost.
