None appears for the Appellant.  No step taken.  On 09.06.2010 the Appellant was present but thereafter on subsequent dates the Appellant was absent on calls and on 07.07.2010 the Appellant was directed to file show-cause.  On 21.07.2010 though the Appellant filed reply to the show-cause but again prayed for time for filing supplementary Affidavit to the application for condonation of delay.  It is evident that on the same ground he took time since 23.06.2010 and today also none present.  Hence we are of opinion that the Appellant is not serious to proceed with the case and the appeal is dismissed for default.
