No. 5/13.05.2010.

Appellant through Mr. P. R. Bakshi, the Ld. Advocate and Respondent No. 1 through Mr. K. S. Basu Roy, the Ld. Advocate are present.  In view of the serious mistake in the Cause Title appeal does not appear to be proper appeal.  Therefore, it is dismissed with liberty to the Appellant to prefer an appeal against the same judgement.  Liberty is also granted to take back the certified copy upon furnishing the Xerox copy of the said certified copy.  The appeal deposit in the present appeal may be taken as appeal deposit in the appeal proposed to be filed in terms of the present order and this order will not be a precedent to other cases.
