             when he enrolled as member in         Accordingly EPF 

 

          

 

 

           and the complainant in turn taking those benefits would not be prevented from the scheme of pension as they worked for more than 10 years,

Undoubtedly, Employees’ Pension Schemes 1997 as well as 1995 provided that a person, who was already a member of the scheme of 1971 and who was under employment as on 16.11.1995 would automatically become a member of   

 

It is not in dispute that the complainant joined as muttah coolie, enrolled as EPF member with A/c.No.AP5640/455 on 01.04.1984, contributed the amount till 1990 and

The learned counsel for the complainant contended that he having put in a service of 14 years entitled to reduced pension.    Labour Court Thereupon, the High Court opined that the only benefit that was denied to him was back wages for the intervening period namely from the date of his termination till the date of reinstatement and therefore his entire period should be treated as continuous for all other purposes except payment of back wages.

 

 However, coming to the facts, admittedly he left the service on 10.11.1990, got EPF and FPF settled in April, 1991.         

 

 

 

 

 

 

Therefore, the appeal is allowed and the order of the District Forum is set aside.
