          The  grievance   of the  complainant  is  deficiency in service  by the opp.parties  in the  present  case.

2.       The  case in brief is that- the  complainant had purchased a HP Laptop  ,Model No. HP15- R007TX, serial NO.CND4291CFH, manufactured  by opp.party No.2  from  opp.party No.1, i.e  Niranjana Sahoo, Proprietor of ITECH SYSTEMS,DERA,TALCHER for  a  consideration of  Rs.39,523.81 .The  laptop was enrolled  for  3 years accidental damage  protection  plan of opp.party No.2 on payment of Rs. 3,999.00. Opp.party No.2 is  the  manufacturer, while opp.party No.3  is the  service  provider. It is orally submitted that, after 2 years  i.e on dt. 23.8.2016 the  laptop was  accidentally slipped  from his lap while    taking a glass of  milk from his  mother and  broken  for which the  complainant  duly informed  the matter to the opp.party No.1 & 2. In  due course  the opp.party No.3  sent an Engineer  who took  the   snaps  of the  parts of laptop and  assured the  complainant  to settle the matter within 2-3  days but  after  a month  receiving  no reply  from the  opp.parties  he  sent  a mail on 18.10.2016  to the  opp.party No.2 . Inspite  of  several  approaches  made by the  complainant, he could not  get the   proper  service  from the opp.parties. Hence the  complainant  has  approached  this  forum  with a prayer to direct the opp.parties  to  replace  the  damage  parts or  to refund the  price of the laptop  and to pay  compensation of Rs. 1,00,000.00   apart  from  litigation expenses  worth Rs. 10,000.00.

3.       The opp.party  No.1 & 2  appeared  and filed  written  version. Opp.party No.3  did not  appear  despite  service of  notice  on  him and   accordingly, he  was  set exparte.

4.       Opp.party No. 1 admitted  the  fact  of purchase of the laptop  by the  complainant  from him  and the  complainant had  also received the extended warranty  by paying  the  extra  money  to opp.party No.2.He  again pleaded that as   per  terms  and  condition of warranty, the  necessary  service shall  have to provided  by the opp.party No.2 & 3.

5. Opp.party No.2   in respect  to the  notice, issued  from this   forum in this  case, appeared  and contested the  case by filing     written version. Sale  of the lap top to the  complainant with the   3years   accidental damage protection on dt. 25.08.2014 is not  denied.

6.       From the   aforesaid  pleading of the parties  the  following  issues  are  settled  for  determination  of the  case.  

 

  1.           Whether  the   complainant  is  a consumer  under the   opp.parties ?
  2. Whether   there is  deficiency in service by the opp.parties  by not  providing  due  service  to the  complainant ?
  3. Whether  the  complainant  is  entitled to  the  reliefs claimed ?

: F I N D I N G S :

Isse No.(i):- The  complainant  has furnished the  documents  relating to the   purchase  of the  laptop  in question from the opp.party No.1. The written version  of opp.party  No. 1 reveals  that, the  opp.party No. 2 is   the  manufacturer  & opp.party  No.3  is the  service  provider. The  complainant   furnished  the  warranty  card,  purchase memo of laptop. Since  the  complainant  has  purchased  the  laptop  under  valid  cash  memo and opp.party No.2 & 3  are  manufacturer  and  service  providers, the  complainant  is a consumer. So  there   cannot be  second thought  that the  complainant  is not a consumer.

 

Issue No.(ii):-        The   complaint petition reveals that, soon after the  incident occurred , the  complainant had  contacted  the opp.parties. The  laptop  was  accidentally broken due  to an unavoidable  situation .​

Issue No.(iii):-       For  the  reasons  stated in respect of  issue No. (i),(ii) & (iii) this forum   feel it  prudent  to  pass an  order, making  the  opp.parties  liable  for the reliefs  claimed by the  complainant.

 

: O R D E R :

It isfurtherclarifiedthatin caseofanydeviationofthisorder, the opp.parties shall pay 12% yearlycompoundableinterest on theirrespectiveliability tillactual paymentis made besides other penalty prescribed in the Act.
