Heard Adv.Mr.S.A.Abhyankar  for the applicant/appellant.

Ld.Counsel states that he may be allowed to withdraw present restoration application with a liberty to approach Hon’ble National commission. In view of decisions taken by this Commission in case of  Shri Suresh Harishchandra Koparkar & Ors. V/s. Shri Prithviraj Khadke & Ors., passed on 15/12/2009 in F.A.no.842/2009  and view taken by Hon’ble High Court at Kerala in the matter of Mr.Raju Thomas V/s. National Insurance Co. Ltd., AIR 2009 KERALA 5, the present application for restoration of A.no.2008/1500 cannot be entertained.  Hence, we pass the following order:-

1.         Misc.Application Nos.503 to 522 for restoration stands disposed of as withdrawn.

2.         Parties to bear their own costs.3.         Dictated on dais.

4.         Copies of the order herein be furnished to the parties.
