This Revision Petition is listed today and, after hearing the arguments of the counsel for both parties and upon perusing the materials on record, this Commission passes the following:-

 

O R D E R

                This Revision Petition is filed against the Order dated 01.06.2022 passed by the DCDRC, Chennai (South) in C.C. No.55/2021, whereby, the District Commission has set the Revision Petitioners herein/ Opposite parties 3 & 4 exparte for non-filing of written version since 02.09.2021 and consequently, adjourned the case to 22.06.2022  for filing proof affidavit of the complainant and 2nd opposite party.

2.     Both present.   

3.     Heard both parties. 

4.     The Revision Petitioners herein/ Opposite parties 3 & 4 were set exparte for non-filing of written version.  Hence, the present Revision Petition.   When the matter had come up before this Commission, the Learned Counsel for the Revision Petitioners herein/ Opposite parties 3 & 4 submitted that the District Consumer Commission, Chennai (South) has refused to accept the Change of Vakalath of the appellants herein and also has not extended the time for filing written version with reasonable cost as per the Supreme Court guidelines i.e. 2021 (3) SCC 673.   Therefore, the Revision Petitioners herein/ Opposite parties 3 & 4 were set exparte on 01.06.2022.   Thus, he prays for setting aside the exparte order dated:01.06.2022 in order to give a chance to the  opposite parties 3 & 4 to contest the case on merits.   When that being the position, we are of the opinion that keeping the Revision Petition filed by the opposite parties 3 & 4 pending will further delay the matter.   Irrespective of the reason assigned by the opposite parties 3 & 4 for non-filing of written version, we are of the opinion that in the interest of justice, this Revision Petition could be allowed by setting aside the exparte order passed by the District Commission so that, the Revision Petitioners / opposite parties 3 & 4 will have a chance to contest the case on merits.

5.     In the result, the Revision Petition is allowed and the impugned order, dated 01.06.2022 passed in C.C. No.55/2021 by the DCDRC, Chennai (South) in setting the Revision Petitioners / opposite parties 3 & 4 exparte is set aside, and the opposite parties 3 & 4 shall file their Versions, Proof Affidavits and the documents/exhibits on their side, if any, in C.C. No.55/2021 on the next date of hearing without fail, whereupon, the District Commission shall proceed with the case in accordance with law, for its early disposal.
