Per – Hon’ble Smt. Usha S. Thakare, Presiding Judicial Member

          Adv. Nikhil Mehta instructed by KMC Legal Venture is present on behalf of the Applicant/Appellant.  Non-Applicant/Respondent in person is present alongwith his counsel Adv. Prithpalsingh J. Nahal.  It is brought to my knowledge that there is amicable settlement of dispute between the parties outside the Commission and in support of this statement ‘Minutes of Order’ are filed on record.  It is agreed between the parties that the Non-Applicant/Respondent (original Complainant) is entitled to withdraw a sum of Rs.11,39,424/- together with interest accrued thereon and the Applicant/Appellant (original Opponent) is entitled to withdraw a sum of Rs.47,046/-, which amount is inclusive of amount of Rs.25,000/- which was deposited by the Applicant/Appellant at the time of filing of the appeal.  Applicant/Appellant is also entitled to withdraw the accrued interest on the sum of Rs.22,046/-.  Minutes of Order are signed by Adv. Nikhil Mehta on behalf of the Applicant/Appellant and Adv. Prithpalsingh J. Nahal on behalf of Non-Applicant/Respondent.  Adv. Nikhil Mehta for the Applicant/Appellant has also produced on record a copy of e-mail sent to him by the Applicant/Appellant.  Parties present before me admit the contents of the ‘Minutes of Order’. 

[2]     In view of amicable settlement of dispute between the parties, Miscellaneous Application No.22 of 2014 seeking condonation of delay for filing First Appeal No.42 of 2014 stands disposed of in terms of ‘Minutes of Order’.  Consequently, appeal does not survive for consideration.  Parties are permitted to withdraw the amounts as per entitlement as mentioned in ‘Minutes of Order’.  Parties shall bear their own costs.
