Both parties file hazira through their Ld. Agents/Advs.
The complainant, Aparna Baul Bhattacharjee has filed a verified petition seeking permission to withdraw the case.
Heard both sides.
It appears from the instant petition that the O.P. No.1 called the complainant at Kolkata and accordingly two agents of the complainant namely i) Sri Manoj Banik and ii) Sri Goutam Roy went to Kolkata and met the O.P. No.1, Kaustav Roy on 23rd June, 2015 at his office and the said O.P. No.1 assured that he would pay the deposited amount to the complainant on condition that if the complainant withdraw the present case and on that ground the complainant is withdrawing the present case.
We do not find any impediment to allow the application.
Hence,
Ordered,
That the complainant is permitted to withdraw the present Case No. DF/73/2014. No costs.
A plain copy of this order be made available and be supplied to the parties by hand/Registered post, free of cost with A/D.
