Shri Kamat, Lr. advocate of the Complainant has submitted tha thte Complainant and his manager had to return on 04/03/2006 without transacting any buisness in the absence of the said certificate and that the Complainant’s trip was like a match washed out.

COnsidering that the entire trip of the Complainant got wasted on account of the loss of the 2 bags, and consequently the said certificate, compensation in sum of Rs. 3.14 lacs cannot be said to be excessive, considering the travel expenses incurred by the Complainant and his manager, expenses for hotel accomodation, expenses for food, loss of some buisness and compensation for mental, emotional suffering. Considering the above aspects, we do not propose to interfere with the award of compensation of Rs. 3.14 lacs , but considering the observations of the Apex Court in Ghaziabad Development Authority wherin the Apex Court has heldthat whenever compensation is directed to be paid, the Forum must direct payment within a particular period and further direct that if payment is not made within that time the Authority
