HON’BLE MR.JUSTICE ISHAN CHANDRA DAS,PRESIDENT                

          This is to consider an application for appointment of Engineer Commissioner to inspect the building, being the subject matter of the original proceeding and to submit a report by 01.04.2021 on the point  as to   whether the building in question is presently habitable or not, upon consideration of the averments, as contained in the body of the application as well as the schedule for inspection and upon consideration of  the averments,  as contained in the Written Version, filed by the Opposite Party.  Upon hearing of the ld.Counsel of the parties, the prayer is allowed .  

           Mr.Alok Kumar Mazumder  is hereby appointed as Engineer Commissioner to inspect the building/property in question who shall inspect the property in question as per requirements noted above and to submit his report by 01.04.2021. The complainant is directed to make payment of a sum of Rs.15,000/- (Rupees fifteen thousand) to the ld.Commissioner before holding inspection by the said Commissioner.

          To 01.04.2021 for submission of report by the ld.Commissioner.  The IA is thus disposed of.
