JUDGEMENT
Heard the counsel for the complainant and counsel for the Op with regard to the suit pending between the parties before the Civil Court and maintainability of this complaint when the same subject matter in the above suit is pending.Learned counsel representing the complainant conceding that issue involved in this complaint is an issue pending before the Civil Court.Therefore submitted by giving liberty to the complainant to raise all the contentions he has taken in this complaint in that suit, complaint may be dismissed as withdrawn.
In view of the above submission, leaving liberty to the complainant to take all the plea he has raised in this complaint in that suit pending between himself and Op complaint is dismissed as with drawn.
