ORDER

Per Shri P.N. Kashalkar, Hon’ble Presiding Judicial Member

          Both parties are absent.

This appeal of 2006 was filed by org. opponent/BPL Mobile Communications Ltd. in this Commission on 10/09/2003.  This was examined by the office on 11/09/2003 and on the same day, office had told Authorised Representative for the appellant that appeal is not accompanied with delay condonation application.  Delay is not properly explained.  Certified copy of the impugned order is not filed.  Copy of complaint, copy of affidavit of complainant, copy of list of documents, etc. were not produced and Authorised Representative for the appellant was directed to remove objections within six weeks.  Thereafter, no steps were taken by Authorised Representative for the appellant.  Authorised Representative Mr.J.B. Gai was appearing for the appellant. No steps have been taken to remove the objections and since then this appeal was lying unattended.  Since, appeal is not accompanied with condonation of delay application and office objections were not removed, we have no option but to dismiss the appeal for non-removal of objections.  So, without going into the merits of the case, we pass the following order :-

                             -: ORDER :-

1.       Appeal is dismissed for non-removal of objections.

2.       No order as to costs.

3.       Copies of the order be furnished to the parties.

Dated 10th October 2011.
