Final Order / Judgement

Learned counsel for the parties are present.

In terms of order dated 29.7.2019, learned counsel for the OP/complainant hands over to the learned counsel for the revision petitioners financer Draft for Rs.55,736/- towards eight outstanding EMIs till August, 2019 which the learned counsel for the revision petitioners financer receives.

Order dated 29.7.2019 reads as follows:-

“Learned counsel for the parties are present.

Branch Manager of the revision petitioners - TVS Credit Services Ltd. is present in person.

Being instructed by the revision petitioners, learned counsel for the revision petitioners makes a statement that on receipt of eight EMIs by 7.8.2019 the repossessed vehicle shall be released in favour of the complainant/OP.

Being instructed by the complainant/OP, learned counsel for the complainant makes a statement that the complainant shall pay to the revision petitioners eight outstanding EMIs amounting to Rs.55,736/- by 7.8.2019.

Put up on 7.8.2019 for payment of dues towards eight outstanding EMIs by the OP to the revision petitioners along with undertaking supported by affidavit that the complainant shall not make any default for making payment of the EMIs in future.”

Learned counsel for the revision petitioners submits that the revision petitioners undertakes to release the vehicle in favour of the OP/complainant on submission of undertaking supported by affidavit to the effect that the OP/complainant shall not make any default in making payment of EMIs in future.

Since dispute between the parties stands resolved, the revision petition is disposed of.

Also CC No. 65 of 2019 pending before the learned District Forum, Jagatsinghpur stands dropped.
