Final Order / Judgement

Hon’ble Mr. Ajeya Matilal, Presiding Member

          Today is fixed for filing affidavit of service by the appellant in respect of respondent nos. 2 to 5. But the appellant is absent without any steps.

          It appears that on more than six occasions the appellant neither appeared nor took any steps for service notice upon the respondent no. 2 to 5.

          So, it appears that the appellant lost his interest to proceed with the appeal.

          In the present appeal the appellant challenges the order no. 24 dt. 16.11.2015 passed by the Ld. DCDRC, Kolkata, Unit-II allowing CC/461/2014 on contest with a cost of Rs. 10,000/-. Perused the impugned order.

          On perusal of the impugned order we do not find any illegality.

          Accordingly, A/235/2016 is dismissed. The impugned order is upheld.

          Order of stay, if there is any, in connection with the present appeal stands vacated.

          Let a copy of this judgment be sent to the Ld. Forum below.

          Joint Registrar of this Commission is directed to do the needful in this regard.
