The complainant filed this case against the o.p. praying for reimbursement of medical expenses incurred by him during the time of his employment. The complainant has raised a dispute relating to the period from 2007 onwards. It appears from the record that the complainant was provided with the medical reimbursement by the fund of The Merchant Navy Officers’ Welfare Fund and subsequently the complainant failed to pay the contribution towards he said fund for which the complainant has not been provided with the medical benefits which he ought to have enjoyed on payment of his contribution to the said fund. Since the complainant himself has not come with clean hand and the case filed by the complainant does not come within the purview of C.P. Act, therefore, accordingly, we hold that the case is not maintainable and the same is dismissed in limini.
