O R D E R

The complainant has filed the present complaint against the O.P under section 12 of Consumer Protection Act, 1986.  The facts as alleged in the complaint are that the Complainant had booked one scooty with OP on 31.07.2018 for Rs. 1000/- vide receipt No. 02749. OP-1 assured and promised that the scooty would be delivered  within one week  and also assured  to reduce Rs. 700/- for Helmet  and Rs. 620  for some extra  warranty/ Insurance as well as Rs. 4500/- for  accessories . It is further stated that the complainant has made  payment of  Rs. 47,688/- without registration certificate. The present complaint has been filed with the prayer that complainant has demanded back Helmet, extended warranty and Accessories payment.

3.        Notice was sent to both the parties but they could not   appeared. Accordingly both the OPs were proceeded ex-parte.
4.      We have heard the complainant in person and perused record.
5.      The documents placed on record indicates that scooty was received by complainant vide delivery challan dated 07.04.2017 with accessories without mud flag foot mat. Delivery challan further suggested that helmet was given with the scooty but there is no document to substantiate that OP-1 had agreed for extended warranty or refund of Rs. 620 or refund of Rs. 4500/- for accessories.  However the OP was duty bound to provide registration certificate of the scooty to the complainant which was not provided at the time of delivery of the vehicle or thereafter. Therefore , we are of the opinion  that OP  should be directed to furnish certificate of registration of scooty to the complainant within period of  two months from the date of this order.  

Copy of this order be sent to the parties as per rules.
