ORDER

Per Justice Mr. S. B. Mhase -  Hon’ble President.

 

 

                   The learned counsel for the respondent invited our attention to the order dated 14/09/2010.  By this order appellant was directed to pay cost of `7,500/- after hearing the parties. The time was directed that within 15 days the amount shall be paid.  However, the amount was not paid after 15 days.  However, we passed an order on dated 14/09/2010 and today the case is fixed for disposal.  But till today amount has not been deposited by the appellant.   As per the said order, appellant had not paid the amount and today also the advocate for party is absent, the General Manager is also absent.   Under this circumstances we have no other option to dismiss the complaint for non compliance of the order dated 14/09/2010.  Hence, we pass the following order.

-: ORDER :-

 

1.                 Appeal disposed of, as the amount of cost on delay condonation have not been complied with as per order dated 14/09/2010.

2.                 No order as to cost.

3.                 Copies be supplied to the parties.
