ORDER

Pers Shri S.R. Khanzode - Hon’ble Prsiding Judicial Member:

 

          There is a delay of 50 days in filing in appeal and therefore, this application is filed for condonation of delay.  The delay is sought to be condoned on medical grounds.  Application for condonation of delay is supported by affidavit by the Appellant and medical certificate is also produced.  Respondent No.1/Original Complainant has seriously opposed this application stating that it is the habit of the Appellant to arise late and take a delayed action.  But, in the background of the present circumstances, we find that the reason is to be accepted and hence, we find that delay is satisfactorily explained.  Respondent No.2 - S.R.A. has nothing to say as submitted by their Counsel.  We hold accordingly and pass the following order:

 

O  R  D  E  R

 

1.Misc.Application No.292/2010 filed for condonation of delay is allowed.

 

 

 2. Delay in filing the appeal stands condoned subject to costs of Rs.5,000/- payable by the Appellant to the Respondent No.1.  Costs be paid within 15 days from the date of allowing of condonation of delay application.  Subject to fulfillment  of this condition appeal is listed for admission to 12.01.2011.
