     Today Advocate Mr.Dalvi for the Non-Applicants/Respondents is present.  He files undertaking to file vakalatnama.  A statement is made on behalf of the Appellant that he had privately served the Non-Applicant/Respondents.  However, fact remains that, he did not comply with the direction dated 06.11.2012 to issue notice with compilation to the Non-Applicants/Respondents through Commission.  Said direction was self operative, in the sense that failure to comply the direction, application together with appeal resulted into dismissal.  In the circumstances, the application along with appeal be struck off from the board.
