As such we are of the considered opinion that the present complaint filed by the Complainant requires to be partly allowed. Although the Complainant has sought for liquidated and exemplary damages of Rs.25,000/- for causing him mental tension we are not inclined to give him any damages as there is no provision under the Consumer Protection Act to grant damages. Moreover, we are also of the opinion that the Complainant although has paid a substantial amount of Rs.1,75,000/- to the Opposite Party yet his approach towards the filing of the complaint is absolutely casual. Accordingly the complaint is partly allowed and the Opposite Party is directed to refund the said amount of Rs.1,75,000/- to the Complainant with pending and future interest at the rate of 9% p.a.
