Mr. J. Joshi, Advocate for the Appellant is present.  He states that the Appellant and Respondent settled the matter out of the Court and therefore, he has received instruction to withdraw the appeal.  Accordingly, he has submitted an application.  Application is allowed.

Appeal is withdrawn alongwith delay condonation application.  Amount deposited at the time of filing of appeal be transmitted to the Consumer Disputes Redressal Forum, Thane District and Consumer Disputes Redressal Forum, Thane District to take a decision as to whether the amount should be paid to the consumer or return to the Appellant.
