Heard Appellant.  Opponent/respondent  prefer to remain absent.

          There is delay of 61 days in filing the appeal.  Hence this application to get condone the delay.  The copy of impugned order dated 31.7.2010 was stated to be received by the applicant/appellant on 10.9.2010 and immediately steps were taken to file an appeal by referring to its legal department and through them submitting papers to its Delhi based lawyer.  The counsel took time to prepare and file the appeal.  The delay occurred is neither intentional nor malafied.  For the latches on part of a lawyer, the party should not suffer.  Hence we find that the delay is satisfactorily explained.  Holding accordingly, we pass the following order :

          Application for delay condonation is allowed.  No order as to costs.
