Case record taken up today for hearing. Complainant as well as O.P 1,2 & 3 are found absent on call. The O.P 4 & 5 are present virtually and submit their case.

Heard the O.P 4 & 5 present virtually .Complainant found absent on repeated call. However, in view of Sec 38(3)(c) of C.P Act, 2019 ,case record is taken up to decide the complaint on merit as it is a year old case of 2019.

Peruse the material available on record and the previous orders passed in this case. It appears that, the complainant is remaining absent consistently. Law is well settled that, mere pleading itself shall not construed evidence. Complainant is to prove the allegation made in her complaint petition but here in this case the complainant failed to adduce cogent evidence to substantiate her claim as such we found no merit in this complaint.

Hence, the complaint is dismissed against the O.Ps for non-prosecution.
