Per Mr. P.N. Kashalkar, Hon’ble Judicial Member :

          Ld. Counsel for appellant has placed on record letter sent by the respondent dated nil executed by the respondent and two indemnity bonds also executed by the respondent and as such appellant has prayed that appeal may be disposed off.  However, we do not know whether his client has withdrawn this appeal or not.  He states that in view of the letter and indemnity bonds, this appeal could be withdrawn.  Hence the order :

O R D E R

          Appeal is dismissed as withdrawn.  The amount deposited by the appellant at the time of filing appeal be refunded to him.
