Both sides are absent on calls. Today is fixed for filing show cause by the Complainant/ Decree holder as to why the case shall not be dismissed due to non prosecution. But no show cause filed by the Complainant/ Decree holder today. It appears from the case record that since 24.5.2016 the case is pending for bringing order of the Hon’ble State Commission. But the Dhr neither filed the order of Hon’ble State Commission nor appeared in person or by its agent and no steps taken so this Forum vide its order dated 30.8.2019 directed to file showcause as to why the execution case shall not be dismissed due to non prosecution. That on 29.11.2019 the complainant / decree holder is absent on calls and no steps taken on their behalf and no show cause filed till today.

So this Forum may presume that the complainants / decree holders are not interested to proceed with the case further. As such the Execution case being no 15 of 2015 is deserved to be dismissed due to nonprosecution.

Hence ordered that the Execution case being no.15 of 2015 be and the same is dismissed due to nonprosecution.
