This case record has been placed before the ld. Judges of Upobhokta Lok Adalat for settlement.

Ld. Advocates for the D/hr. side and J/dr. side are found present.

Heard and considered submission.

According to the submission of the ld. Lawyers the awarded amount has already been paid. D/hr. admits the same. It is also admitted fact that deed of conveyance in respect of the schedule mentioned property has already been executed and D/hr. has no further grievance.

In view of this position, ld. Advocate for the J/dr. no. 2 has prayed before this Lok Adalat for expunging the name of Sri Bikas Talukdar from the cause title.

Over this issue ld. Judges of this Lok Adalat considering the matter and of the view that this prayer may be allowed.

So, let the name of the J/dr. no. 2 be expunged.

The prayer of the J/dr. no. 1 for reconsideration the amount which is to be deposited in the fund of Consumer Legal Aid Account is also considered and allowed.

Instead of payment of Rs. 4,79,600/- the J/dr. no. 1 is directed also to deposit Rs. 40,000/- within two months from the date of this order in the fund of Consumer Legal Aid Account by way of bank draft of Nationalized Bank.

Thus, this case is settled and disposed of.

Let a true copy of this order be handed over to both sides at free of cost.
