JUDGMENT

JUSTICE SHRI. P.Q. BARKATH ALI :  PRESIDENT

            Heard.  The 1^st opposite party was exparte before the Forum.  Taking into account the nature of contentions raised by the parties.    I feel that an opportunity should be given to the Appellant to contest the matter on merits.  Therefore appeal will be allowed on payment of cost of Rs.5,000/- (Rupees five thousand only) to the complainant.

          2.  Appellant is permitted to pay the cost to the complainant before the Fourm.  This appeal is allowed.  The impugned order of the Forum allowing the complaint is set-aside.  The matter is remanded to the Forum to fresh disposal in accordance with law.  Both parties shall appear before the Forum on 30/11/2016.  The Appellant shall pay the cost to the complainant before the Forum.
