Pursis & Application taken on record.  The complainant and his Ld. Adv. present and stated that there are lots of error while drafting by earlier Ld. Adv. and since many amendment required to correct the complaint. They sought liberty to file fresh complaint after putting all facts.  Ld.Adv. for opposite party has No Objection subject to suitable cost for burdening them litigation.  It is clearified that for mistake of Advocate cost can not be imposed upon poor complainant.  Hence the complainant’s application is allowed and present complaint is “Disposed off as withdrawn with liberty to file fresh complaint within 30 days of receipt of order”.  No cost is imposed in the interest of justice, equity & fairplay.
