Today learned cousenl Sh. M.C. Mahtolia for respondent has appeared and stated that he has come from Rudrapur, Nainital to contest the appeal.

A perusal of the appeal has shown that the appellant did not appear on the previous dates whereas learned counsel for the respondent has appeared on that date.

Today none has appeared on behalf of the appellant even inspite of several calls at different intervals.

Thus, we are of the opinion that the appeal should be dismissed.

Accordingly, the appeal is dismissed in absence of the appellant. No order as to costs.

File be consigned to the record room alongwith copy of this order.

A copy of the order be sent to the concerned District Commission for perusal and necessary information.
