ORDER:
This complaint has been filed by the complainant u/s 12 of the Consumer Protection Act 1986, on the averments that he is consumer of the Opposite Party (in short OP) having gas connection bearing consumer No. 2854 . In this regard SV No.2011624 dated 7.2.1997 was issued and DBC was issued vide SV No.9186261 dated 5.2.1997. However, OP issued Domestic Gas Customer Card No.15800606 in the name of Rajesh Gupta instead of Rajnesh Gupta. He requested the OP a number of times to correct name in the said card, but the representative of the OP demanded amount of Rs.2000/- for issuance of duplicate Domestic Gas customer card and correct the name in his card. He had shown even the original subscription voucher to OP wherein his name has been written as Rajnesh Gupta r/o 17-A, Purshsotam Garden, near Avtar Colony, Karnal and also produced ration card, Aadhar card as well as copy of the bank account maintained with United Bank of India, Karnal, but the OP refused to correct his name and issue duplicate domestic gas customer card. Thus, there is deficiency in service and unfair trade practice on the part of OP, due to which he has suffered mental agony and harassment.
2. Notice of the complaint was given to the OP, which was duly served, but none put into appearance on behalf of OP despite repeated calls. Therefore, ex parte proceedings were initiated against the OP vide order dated 24.6.2015.
3. In evidence of the complainant, he filed his affidavit Ex.C1 and documents Ex.C2 to Ex.C7.
4. We have heard the learned counsel for the complainant and have gone through the case file very carefully.

As per case of the complainant he is consumer of the OP having gas connection bearing Consumer NO.2854, but in the Domestic Gas customer card his name has been mentioned as Rajesh Gupta instead of Rajnesh Gupta. He approached the OP for correction of the name, but representative of the OP demanded Rs.2000/- for that purpose. The OP refused to correct his name despite showing original subscription voucher, ration card, Aadhar card and bank account pass book. The complainant in his affidavit has reiterated the allegations made in the complaint. The documents Ex.C2 to Ex.C7 are sufficient to establish that name of the complainant is Rajnesh Gupta r/o 17-A, Purshsotam Garden, near Avtar Colony, Karnal.
5. This evidence of the complainant has gone completely unrebutted and unchallenged and there is no reason to disbelieve the same. From the evidence on record, it is established that OP had not corrected the name of the complainant in the Domestic Gas Customer Card despite production of documents by the complainant regarding his correct name and address and thus, there is deficiency in services on the part of the OP.

In view of the foregoing discussion, we accept the present complaint and direct the OP to correct the name of the complainant in the Domestic Gas Customer Card as Rajnesh Gupta instead of Rajesh Gupta. The OP shall also pay a sum of Rs.2200/- to the complainant for the harassment caused to him and for legal fee and litigation expenses. The OP shall make the compliance of this order within a period of thirty days from the date of receipt of the copy of this order. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
