PER MR. JUSTICE R.K. BATTA, PRESIDING MEMBER Heard Counsel for the Petitioner. The Petitioner did not contest the matter before the District Forum and the matter had proceeded ex parte against the Petitioner. The District Forum directed the present Petitioner to pay a sum of Rs.13,538/- with 5% interest p.a. from the date of filing of complainant. Besides that a sum of Rs.5000/- was awarded for physical and mental harassment and Rs.1000/- towards cost. This order was challenged before the State Commission by filing appeal. Alongwith the appeal an application for condonation of delay was filed. The delay was for 63 days and the explanation given has been duly considered and rightly rejected by the State Commission. We concur with the State Commission that the said explanation cannot be considered sufficient to condone delay of 63 days. In view of this, we do not find that any case has been made out for interference in the exercise of revisional jurisdiction under Section 21(b) of Consumer Protection Act, 1986 as we do not find any jurisdictional error, illegality or material irregularity in the impugned order. The revision is, accordingly, dismissed with no order as to costs.
