Case has been called out.  Smt. Manjula, Advocate is present on behalf of the appellant.  Sh. Alok Bhatara, Advocate has put in appearance on behalf of respondent No. 3.  None is present on behalf of respondent Nos. 1 and 2.

An application has been filed on behalf of the appellant, with a prayer that this appeal may be dismissed.

Heard learned counsel for the appellant and respondent No. 3.  It has been mentioned in the application submitted on behalf of the appellant that respondent    No. 3 has paid the decretal amount of Rs. 68,100/- (Rupees Sixty Eight Thousand One Hundred Only) through cheque No. 089457 dated 03.12.2019 issued by HDFC Bank, New Delhi to respondent No. 1 / complainant, hence the appellant does not want to press this appeal.

In the light of aforesaid facts and circumstances of this case, the application filed by the appellant is allowed and the appeal is dismissed, as not pressed.

The statutory amount of Rs. 25,000/- deposited by the appellant at the time of filing the appeal, be released in its favour.
