The complaint filed against the opposite party under Section 12 of the Consumer Protection Act 1986 the complainant is heard for admission.

2. The brief of the complaint is as follows:- The complainant is a contractor by profession and he entered into an agreement with the opposite party for the construction of a building. As per the terms and conditions of the contract the complainant completed the work. The building which was constructed having square feet extent of 1830 as per the directions terms and conditions of the agreement entered into by both parties. The amount fixed is Rs.3,66,000/- the opposite party denied to give the balance amount Rs.2,23,800/- to the complainant.

3. The complaint filed is alleging deficiency in service on the part of the opposite party. The complainant is heard. The allegation raised against the opposite party mainly based on breech of contract. The complaint itself does not came within the ambit of invoking provision of Consumer Protection Act since the complainant is not a consumer. The relief prayed by the complainant is of civil nature. We are in the opinion that the complaint is not maintainable hence dismissed.
