     Advocate Mr. Rahate who represents the appellant is present. He filed a pursis requesting that as the impugned order has been fully complied with by the respondent No. 3, the present appeal has become infructuous. Advocate of the appellant therefore seeks permission to withdraw the present appeal and he requested for  refund of statutory amount of Rs. 25,000/- deposited by the appellant with the Forum below.

     Advocate Mr. Kshirsagar is present for respondent No. 1. The respondent No. 1 in person is also present and he has no objection to grant permission to the appellant to withdraw the appeal and to refund statutory amount of Rs. 25,000/- deposited by the appellant with the Forum below. Therefore the appeal is dismissed as withdrawn.

     The statutory amount of Rs. 25,000/- deposited by the appellant with the Forum below be refunded to the appellant after due verification of record of the Forum, about said deposit.  Copy of the order be furnished to both the parties, free of cost and its one copy be also forwarded to the District Forum below for information.
