              None for the appellants is present. Its counsel Mr R K Deshmukh is also absent since, 26.08.2010. Therefore, this application deserves to be dismissed in default. Respondent Mohammad Usman with his counsel Mr S M Kasture is present. Adv. Mr Kasture has filed his Vakilpatra today.

                On perusal of this application it reflects that this application is filed for restoration of appeal bearing No.A/08/728, which came to be dismissed in default on 06.04.2009. But this application for restoration of appeal before this Commission is being not tenable cannot be entertained. This Commission has no jurisdiction to restore any appeal or complaint, which is dismissed in default. Hence, on any count, this application is liable to be dismissed and hereby it is dismissed. 

           No order as to cost.

           Copy of this order be supplied to the parties.
