   This Revision Petition is listed today and, after hearing the arguments of the counsel for the Revision Petitioner and upon perusing the materials on record, this Commission passes the following:-

 

 

O R D E R

                This Revision Petition is filed against the Order, dated 19.12.2022 passed by the DCDRC, Chennai (South) in C.C. No.243/2022, whereby, the District Commission has set the Revision Petitioners herein/ Opposite parties 3 & 4 exparte for non-filing of written version within the statutory period of 45 days and consequently, adjourned the case to 19.01.2023 for filing proof affidavit of the complainant and opposite parties 1 & 2.

 

2.     Heard the Revision Petitioners herein/ Opposite parties 3 & 4.  There was no representation for the 1st Respondent / Complainant.  Initially, M/s. Rajeev, Advocate undertakes to file Vakalath for the Respondents 2 & 3 / Opposite parties 1 & 2, but subsequently failed to file Vakalath as undertaken by him. 

 

3.     The Revision Petitioners / Opposite parties 3 & 4 were set exparte for non-filing of written version before the District Commission within the statutory period of 45 days.  When the matter had come up before this Commission, the Learned Counsel for the Revision Petitioners / Opposite parties 3 & 4 stated that when the matter was posted on 19.12.2022 for filing version of the opposite parties 3 & 4, the 3rd opposite party was not feeling well and as a result of which, he was not in a  position to give instruction to his Counsel to file written version and hence, the written version of the 3rd & 4th opposite parties could not be filed before the District Commission.  Thus, they pray for setting aside the exparte order dated:19.12.2022.  When that being the position, we are of the opinion that keeping the Revision Petition filed by the opposite parties 3 & 4 pending will further delay the matter.  Irrespective of the reason assigned by the opposite parties 3 & 4 for non-filing of version, we are of the opinion that in the interest of justice, this Revision Petition could be allowed by setting aside the exparte order passed by the District Commission so that, the opposite parties 3 & 4  will have a chance to contest the case on merits.

 

4.     In the result, the Revision Petition is allowed and the impugned order, dated 19.12.2022 passed in C.C. No.243/2022 by the DCDRC, Chennai (South) in setting the Revision Petitioners / Opposite parties 3 & 4 exparte is set aside, and the Opposite Parties 3 & 4 shall file their Versions, Proof Affidavits and the documents/exhibits on their side, if any, in C.C. No.243/2022 on the next date of hearing without fail, whereupon, the District Commission shall proceed with the case in accordance with law, for its early disposal.
