ORDER:
Today the case was fixed for issuing notice to opposite parties Nos.3 & 4.
Shri Adarsh Chaturvedi, Finance Head of Cuckoo Appliances Pvt. Ltd. – opposite party No.3 has made a statement that “ we are ready to replace the air purifier.
On the other hand, counsel for the complainant orally stated that he wants to harassment and litigation charges.
On the basis of the statement of Shri Adarsh Chaturvedi, Finance Head of Cuckoo Appliances Pvt Ltd. – opposite party No.3, the Commission is of the opinion that the complaint was filed in March 2023 and Shri Adarsh Chaturvedi, Finance Head of Cuckoo Appliances Pvt Ltd. – opposite party No.3 has made a statement that “we are ready to replace the air purifier. Opposite parties have harassed the complainant mentally. Hence, opposite parties are negligent on their part. Deficiency of service is proved. . Hence the complaint is disposed off with the direction to the opposite parties to replace the air purifier with New one of the same amount and with same warranty free of cost. Opposite parties are also directed to pay Rs.2200/- as compensation for causing mental agony and harassment alongwith Rs.2200/- as litigation expenses to the complainant. The complainant is also directed to hand over the old air purifier in question to the opposite parties after receipt of the copy of the order. Compliance of this order be made within 30 days from the date of receipt of copy of this order. Copy of this order be sent to the parties concerned free of costs. File be consigned to the record room.
