Mr. Jagvir Bhadana appearing as proxy counsel for Mr. Yogesh Chhabra, main counsel for the appellant, seeks adjournment on the ground that Mr. Yogesh Chhabra is seriously ill and he has been hospitalized in Sir Ganga Ram Hospital. We are not inclined to accede to the request of the proxy counsel because on record we find that not only Mr. Yogesh Chhabra is the counsel for the appellant but another counsel, Mr. R.K. Sharma is also the counsel for the ..2.. appellant as would appear from the Power of Attorney and the Memo of Appeal. No explanation is coming forth for non-appearance of Mr. R.K. Sharma even if we presume that Mr. Yogesh Chhabra is ill. In these circumstances, the first appeal is dismissed, more particularly, so when we find that the appeal has been filed after a delay of 160 days.
